Please read these Terms of Service carefully before using Dermlink. These Terms constitute a legally binding agreement between you and Precision Radiance Inc., d/b/a Dermlink, governing your use of our telehealth platform and related services.
By accessing or using the Dermlink platform, mobile applications, and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.
We may update these Terms from time to time. Material changes will be communicated via email and a notice on the platform at least 30 days before taking effect. Your continued use after changes take effect constitutes acceptance.
Dermlink provides an asynchronous and synchronous telehealth platform connecting patients with board-certified dermatologists. Our Services include: photo-based skin assessments, live video consultations, prescription management, care plan documentation, and related clinical and administrative features.
Dermlink is a technology platform that facilitates the delivery of healthcare services. The dermatologists on our platform are independent licensed practitioners who exercise independent clinical judgment. Dermlink does not practice medicine and does not interfere with the practice of medicine by its providers.
To use Dermlink, you must: be at least 18 years of age (or have a parent/guardian create an account on your behalf), be physically located in a state where your provider is licensed at the time of consultation, provide accurate and complete registration information, and have the legal capacity to enter into a binding agreement.
Dermlink Services are currently available in the United States only. Availability of specific services may vary by state due to differences in telehealth regulations.
You must create an account to use our Services. You agree to provide accurate, current, and complete information during registration and to keep this information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized access or use of your account.
Each account is for a single individual. You may not share your account or allow others to access your account. Parents/guardians may create accounts for minor dependents.
The information provided through Dermlink is for informational and treatment purposes and does not replace in-person medical care. Our Services are not intended for medical emergencies. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately.
Telemedicine has inherent limitations. Not all conditions can be diagnosed or treated remotely. Your dermatologist may recommend an in-person visit if they determine that your condition requires physical examination or procedures that cannot be performed virtually.
Consultation fees are displayed before you book and are charged at the time of booking. Prices are subject to change, but any changes will not affect already-booked consultations.
We accept major credit cards, debit cards, and HSA/FSA cards through our secure payment processor (Stripe). You authorize us to charge your selected payment method for all fees incurred.
If a dermatologist has not yet reviewed your case, you may cancel for a full refund. After a consultation has been completed, refunds are issued at our discretion on a case-by-case basis. Contact support@dermlink.ai for refund requests.
Dermlink currently operates on a self-pay model. We provide detailed superbills upon request that may be submitted to your insurance for potential out-of-network reimbursement. Dermlink makes no guarantee of reimbursement.
When using our Services, you agree to: provide truthful and complete health information, upload only your own medical images (or those of a minor for whom you are the legal guardian), not use the Services for any unlawful purpose, not attempt to access another user's account or data, not interfere with or disrupt the platform's operation, and comply with all applicable laws and regulations.
You understand that the accuracy and completeness of the information you provide directly affects the quality of care you receive. Providing false or misleading information may result in inappropriate treatment recommendations.
The Dermlink platform, including its design, code, content, logos, and trademarks, is owned by Precision Radiance Inc. and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial healthcare purposes.
You retain ownership of the content you submit (photos, medical history, messages). By submitting content, you grant Dermlink a limited license to use it for the purpose of providing Services to you and, in de-identified form, for platform improvement and clinical research.
To the maximum extent permitted by applicable law, Dermlink and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services.
Dermlink's total liability for any claims arising under these Terms shall not exceed the amount you paid for the specific consultation giving rise to the claim. This limitation applies regardless of the legal theory on which the claim is based.
Nothing in these Terms limits liability for: gross negligence or willful misconduct, fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that cannot be limited by applicable law.
Any disputes arising from these Terms or your use of the Services shall first be addressed through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in San Francisco, California.
You agree that any arbitration will be conducted on an individual basis and not as a class action, class arbitration, or representative action. You waive the right to participate in class actions to the fullest extent permitted by law.
You may close your account at any time by contacting support@dermlink.ai. We may suspend or terminate your account if we reasonably believe you have violated these Terms, with notice when practicable.
Upon termination, your right to use the Services ceases immediately. We will retain your health records as required by applicable law. You may request a copy of your records prior to or after account closure.
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. The delivery of healthcare services is additionally governed by the laws of the state where the patient is physically located at the time of consultation.
